Error to district court, Albany county. This was a proceeding in equity by the United States to restrain defendant corporation from unlawfully inclosing public lands. The district court dissolved the temporary injunction, and dismissed the petition. The plaintiff brings error.

On the 1st day of July, 1862, the congress of the United States passed an act entitled “An act to aid in the construct] on of a railroad and telegraph line from the Missouri river to the Pacific ocean, and to secure to the government the use of the same for postal, military, and other purposes.” By the first section of this act the Union Pacific Railroad Company was created, erected into a body corporate, and given the customary powers of a corporation.
