—In *382an action, inter alia, for a judgment declaring invalid the imposition of commercial rent tax by the defendant upon the payments made by the plaintiff to Market Operating Corp., the plaintiff appeals from an order of the Supreme Court, Kings County (Hurowitz, J.), dated April 2, 1992, which granted the defendant’s motion to dismiss the complaint.
Ordered that the order is affirmed, with costs.
