This state prisoner habeas case presents the question of whether petitioner was denied his Sixth Amendment right of self-representation as enunciated in Faretta v. California, 422 U.S. 806, 95 S.Ct. 2525, 45 L.Ed.2d 562 (1975). We dismissed an earlier habeas petition filed by petitioner in this Court for failure to exhaust, see Martin v. Wyrick (W.D.Mo.1976) 411 F.Supp. 1069, in order to afford both the Missouri Court of Appeals, Kansas City District, which affirmed petitioner’s conviction on direct appeal in State v.
