This suit was brought in the name of the State of Maryland to the use of the County Commissioners of Prince George's County, against the Baltimore and Ohio Railroad Company, to recover fines to the amount of eight hundred and fifty dollars, for the failure of the defendant to comply with the provisions of the Act 1908, Chapter 398, requiring the company to erect and maintain safety gates and to keep flagmen at certain public road crossings in said county. The Act is as follows:
