The present action is based upon a written contract dated August 4, 1939, executed during cover-ture of M. Lucille Allen and Walter E. Allen and which was entered into in contemplation of the severance of their marital relationship. On the 10th day of August, 1939, a decree of divorce was granted to Walter E. Allen against M. Lucille Allen in the district court of the Second Judicial District of the State of Nevada. The contract provides that Mr. Allen will pay Mrs. Allen the sum of $1,680 each year at the rate of $140 monthly, commencing on August 1, 1939, for the remainder of Mrs. Allen’s…
