BEAUCHAMP, Judge.

Appellant was convicted of the offenée of rape by force of Jeanne Hogan, a female under the age of eighteen years. The penalty assessed is death.

The prosecuting witness was working at the Kress Store in Austin and was relieved from duty at 7:00 o’clock, p. m., on December 18, 1942. She caught a bus which discharged her at the intersection of South First Street with Live Oak in the extreme- south portion of the City of Austin at 7:30.
