MEMORANDUM OF OPINION AND ORDER
KRENZLER, District Judge.
This is another Title 42 U.S.C. § 1983 case (hereinafter referred to as § 1983) in which the plaintiff, Robert Haag, 1 a father, is alleging that his constitutional right of visitation with his children has been infringed upon by the various defendants under color of law.
Plaintiffs principal argument is that because the Cuyahoga County Welfare Department did not meet its mandated statutory duty, pursuant to Ohio Rev.Code Ann. § 2151.421, he was denied the above-noted right of visitation.
