Appeal by both parties from a judgment entered on a decision of a special term, and heard in this court on a ease which contains all of the evidence, exceptions to the decision by both parties, and requests preferred by the plaintiff, pursuant to section 1023 of the Code of Civil Procedure. Franklin street extends northerly and southerly through the city of Syracuse, crossing West Genesee street. Both were used as public streets before the city was incorporated.
