ALEXANDER HARVEY, II, Senior District Judge:

This is an appeal from a final order of the United. States District Court for the Eastern District of Virginia. 753 F.Supp. 607. In ruling on cross-motions for summary judgment, the district court granted plaintiffs’ motion for summary judgment, and held that the governmental eviction of *1302a public housing tenant without prior notice and an opportunity for a hearing was viola-tive of the due process clause.
