STEPHENSON, Justice.

This is ah appeal from the judgment of ■the trial court awarding plaintiff total and permanent disability under the Workmen’s Compensation Law.. The parties will be designated here as- they were in the trial court.

Defendant contends first that there was no evidence that plaintiff was an employee of the assured, W. B. Cariker, doing business as W. B. Cariker Lumber Company.
