Two questions are presented: (1) Did the People present sufficient evidence to justify a finding that the defendant was guilty of a violation of the statute upon which the information is based; and (2) if not, is the defendant upon this record in a position to question the sufficiency of the proof.

The information duly filed contained two counts. The first charged that “ The said defendant on the 9th day of September, 1935, at the City of New York, in the County of Bronx, at premises 1353 Boston Road, in the aforesaid county, with intent to defraud, unlawfully and wrongfully exposed for sale…
