The plaintiff brought this bill against the Duncan Construction Company, the city of Medford, and the New Amsterdam Casualty Company, hereinafter referred to, respectively, as the contractor, the city, and the surety, alleging that the contractor entered into a contract with the city for the construction of a school building and defaulted in performance of the contract.
