The defendants, jointly tried, were convicted of the murder of Antonio Ruiz and sentence of death pronounced against them. From the judgment and from the order of the court denying them a new trial they prosecute their appeals.

The court admitted in evidence declarations made by the defendant Cota. Cota’s statement was given under the following conditions: He had been arrested and placed in the county jail.
