This appeal arises out of the district court’s grant of habeas corpus to a Michigan prisoner. The petitioner-appellee and cross-appellant, Lanier McPherson (“McPherson”), was convicted by a jury in Wayne County Circuit Court of flrst-de- gree murder, felon in possession of a firearm, and possession of a firearm during the commission of a felony. The district court granted his habeas corpus petition pursuant to 28 U.S.C. § 2254 on his Fifth Amendment claim but denied his petition on all other grounds.
