delivered the opinion of the court:

On the 23d day of February, 1892, William Laiferty deeded to Richard Garrett and his two sons, David J. and Douglas, jointly, the south-west quarter and the west half of the south-east quarter of section 33, township 13, north, range 3, west, in Mercer county, this State. On the 13th day of July, 1893, Richard Garrett made a will, by which he disposed of all his real estate, consisting of over three hundred acres, besides the above described land conveyed to him and his said sons jointly, and also of his personal property.
