Plaintiff James Karsner filed an action against defendants Lechters Illinois, Inc., and Lechters, Inc. (collectively, Lechters), for injuries he sustained while unloading a trailer containing Lechters’ merchandise. Lechters filed a third-party indemnity action against James’ employer, Navajo Express, Inc., and its parent company, Navajo Shippers, Inc. (collectively, Navajo). The trial court granted Navajo’s motion to dismiss Lechters’ action, and Lechters appealed.
