MEMORANDUM OPINION AND ORDER
SPRIZZO, District Judge:
Plaintiff Retirement Fund of the Fur Manufacturing Industry (the “Fund”) brought this action to collect payments of withdrawal liability under the Employee Retirement Income Security Act of 1974, (“ERISA”), as amended by the Multiem-ployer Pension Plan Amendments Act of 1980 (the “Multiemployer Act”), 29 U.S.C. § 1001 et seq. (1982). The following shall constitute the Court’s findings of fact and conclusions of law in accordance with Rule 52 of the Federal Rules of Civil Procedure.
