This is an appeal by the employer and insurer from a judgment of the Superior Court of Baltimore City affirming the decision of the Workmen’s Compensation Commission that the claimant is permanently totally disabled and that his disability is not due, in part, to a pre-existing disease. The question presented is whether the trial court erred in refusing to submit to the jury an issue on apportionment in the form proposed by the appellants.
