Certiorari by Adam A. Cross to review the action of James J. Martin and others, constituting the board of police commissioners of the city of New York, in dismissing relator from the police force. Reversed.

On the 13th day of August, 1894, certain charges, 46 in number, were presented to the respondents against the relator, who was then a captain of the police force of the city of New York. Notice of the preference of said charges, and of the time and place when the same would be publicly examined, was served upon the relator; and thereafter, on the 15th day of August, 1894, and subsequent days, a trial was had, and on the 31st day of August it was by the said police commissioners “resolved, declared, ordered, and adjudged that the said charges are true, and that the said Adam A.
