This case arises from an award of attorney’s fees to the plaintiffs for legal work performed by the Mental Health Legal Advisors Committee (MHLAC)3 in a civil rights suit against the Department of Mental Health (DMH or depart*851ment). The plaintiffs had sought the fees under three statutes that allow an award of attorney’s fees to a “prevailing” party in such suits: 42 U.S.C. § 1988 (1994) (§ 1988); 42 U.S.C. § 12205 (1994) of the Americans with Disabilities Act (ADA); and G.
