In August, 1939, John L. Wiegardt and wife, G. A. Wiegardt and wife, and Fred W. Wiegardt and wife, doing business as Wiegardt Brothers, brought an action in the superior court for Pacific county against Alfred Becken and wife, for an accounting covering a period from the time of the execution of a certain agreement dated September 3, 1935, up to the time'the action was instituted. The action was tried by the court, and resulted in a judgment dismissing plaintiffs’ action.
