Plaintiff Gucci America, Inc. (“Gucci”) commenced this action on against defendants Duty Free Apparel, Ltd. (“DFA”), Joel Soren (“Soren”) 1 and John Does 2-20 (collectively “Defendants”) 2 alleging trade mark infringement pursuant to the Lan-ham Act, 15 U.S.C. §§ 1051, et seq. (2003), and asserting various related claims under New York law. Defendants raise two counterclaims under New York law, namely, violation of N.Y. Gen. Bus.
