This is an action in partition commenced on September 29, 1916, the complaint alleging that the plaintiff Harway Improve*176ment Company and the defendant Hugh R. Partridge are seized in fee as tenants in common of certain property abutting on Gravesend bay and Coney Island creek or the Gravesend ship canal, plaintiff alleging that it owns three-fourths of the premises and that defendant Partridge owns-the remaining one-fourth part.
