CAMERON, Justice.

This special action challenges a ruling on a motion in limine by the Pima County Superior Court, precluding the State from using the defendant’s nine California murder judgments as aggravating circumstances under the Arizona death penalty statute, A.R.S. § 13-703. We accepted jurisdiction because of the punishment involved, because there was no plain, adequate, or speedy remedy by appeal, and to prevent what we perceived to be a misapplication of the law.
