ROBERTSON, Presiding Judge.

Willy Sherman Brumett appeals from a summary judgment entered by the Circuit Court of Autauga County in favor of Everywhere Trucking Company, Inc. (“ETC”), on his claim seeking workers’ compensation benefits. We reverse and remand.

Brumett filed his complaint in the Circuit Court of Etowah County on July 18, 1997, seeking compensation for injuries he sustained to his neck and back while working in the line and scope of his employment at ETC.
