MEMORANDUM

WANGELIN, Chief Judge.

This matter is before the Court for a decision on the merits following a five-day bench trial held June 25 through 28, 1979 and January 23, 1980. In his complaint, brought pursuant to Title VII of the Civil Rights Act of 1964,42 U.S.C. § 2000e et seq. and The Civil Rights Act of 1870, 42 U.S.C. § 1981, plaintiff alleges violations of those *134statutes by reason of defendant’s alleged failure to promote plaintiff because of his race.
