The plaintiff, Hanover Insurance Company (“Hanover”) brings this action for negligence, breach of fiduciary duty, violation of G.L.c. 93A, §11 and declaratory judgment against defendant, Penn-America Insurance Company (“Penn-America”). Hanover, as assignee, is also now pursuing the crossclaim for negligence, breach of fiduciary duty and violation of G.L.c. 93A, §11 brought against Penn-America by Congress Management Company (“Congress”).
