Defendant pled guilty to the second degree murder of his brother, James Earl Higson, and to the assault of his sister-in-law, Patricia Stocks Higson. At the sentencing hearing the trial judge was apprised of the following facts in connection with the crimes: On 28 February 1982, James and Patricia Higson and their son David were returning to Greenville from Belhaven when they decided to stop by the home of James Higson’s parents.
