MEMORANDUM DECISION

BRUCE W. BLACK, Bankruptcy Judge.

This matter is before the court for decision on the Motion for Summary Judgment filed by Charter One Bank, the Defendant, in this adversary proceeding, and its Motion to Vacate the Order of Confirmation entered in the underlying bankruptcy case. The Debtors commenced this adversary proceeding to avoid the Defendant’s junior mortgage lien on the Debtors’ residence. Prior to judgment in the adversary case, the Debtors filed a modified plan that purported to avoid the junior lien and moot the adversary proceeding. For the following reasons,…
