' OPINION

ARMIJO, Judge.

{1} The formal opinion filed on April 9, 1999, is hereby withdrawn and the following-opinion is substituted. The motion for rehearing filed by Defendant is denied.

{2} Defendant appeals his convictions stemming from his participation in a burglary in Aamogordo, New Mexico, in the summer of 1995. As the sole ground for his appeal, Defendant asserts that his speedy trial right was violated by the passage of twenty-one months between the time of his arrest and trial. We affirm Defendant’s convictions.
