Appellant Fernando Rodriguez appeals the order of the Benton County Circuit Court convicting him of first-degree murder. On appeal, Rodriguez argues that the circuit court erred in admitting the out-of-court statement of a witness as an excited utterance. Within this argument, Rodriguez also argues that the admission of the statement resulted in a violation of his rights under the Confrontation Clause of the Sixth Amendment to the United States Constitution.
