Mary Spiegel died March 27, 1913, at the home of Christopher Columbus Crabb, one of the defendants in error, in the city of Chicago, leaving a paper purporting to be her last will and testament. This paper was admitted to probate in the probate court of Cook county. From that order an appeal was taken to the circuit court, where a like order admitting the' will to probate was entered.
