Merck & Co., Inc. (“Merck”) seeks to deny Kenneth Havis (the chapter 7 “Trustee”) the ability to reopen this bankruptcy case to prosecute a lawsuit against Merck. Technically, Merck’s motion is a motion to reconsider the Court’s order allowing the Trustee to reopen the case.
