Order unanimously modified, on the law, and, as modified, affirmed, without costs, in accordance with the following memorandum: On September 10, 1973, an oil and gas lease of a 120-acre parcel of land in the Town of French Creek was granted by the owners to Oxford Associates (Oxford) for a 10-year term. Thereafter, Oxford assigned the lease to Consolidated Gas Supply Corp. (Consolidated). On April 20, 1982, Consolidated assigned the lease to plaintiff.
