Judgment unanimously modified on the law and as modified affirmed without costs, and matter remitted to Supreme Court, Chautauqua County, for further proceedings, in accordance with the following memorandum: Defendant contends that the jury verdict in favor of plaintiff in the amount of $20,000 compensatory damages and $250,000 punitive damages for trespass, and $70,000 compensatory damages for plaintiff’s unfair pooling claim must be set aside and a new trial granted.
