The defendant Aubrey Shaw, was charged on January 1, 1946 in the county court of Comanche county, Olda., of being in the unlawful possession of intoxicating liquor. Op January 2, 1946, he was arraigned and sentenced to serve a term of 30 days in the county jail, and adjudged to pay a fine of $75.

The conviction was based upon a plea of guilty made and entered without the aid of counsel at the time of arraignment.

There is a sharp conflict in the testimony as to what occurred during the arraignment, and as to whether the defendant intended to enter a plea of guilty.
