This is an original proceeding in habeas corpus wherein Burrell Bradley seeks his release from confinement in the State Penitentiary.

In a verified petition filed herein, it is stated:

“That the petitioner was arrested on January 15, 1910, and taken to the county jail at Idabel, Oklahoma, and there held incommunicado; that the petitioner was cruelly beaten without any cause or provocation. That on January 17, 1910, an information was filed in McCur-tain county, charging petitioner with larceny of domestic animals; that he was taken immediately before the district judge of said county without…
