Following a bench trial, the court awarded plaintiff Olympic Marine Services, Inc. (hereinafter “Olympic”) $141,678, plus costs and prejudgment and postjudgment interest, after concluding that defendant United States breached its contract with Olympic. Specifically, the court equitably adjusted the contract, in which Olympic agreed to deactivate a United States public vessel, to reflect the unforeseen and substantially worse condition in which Olympic found the vessel.
