In an action to recover a down payment for the purchase of a custom boat in the sum of $160,000, the plaintiff appeals from so much of an order of the Supreme Court, Nassau County (Austin, J.), dated November 26, 2008, as amended December 11, 2008, as deemed the defendants’ answer amended to provide for a counterclaim for actual damages in the maximum amount of $160,000, and the defendants cross-appeal, as limited by their brief, from so much of the same order as, in effect, granted that branch of the plaintiffs motion which was for summary judgment determining that the liquidated damages…
