The pertinent factual background establishes the following: On May 3, 1971, Day entered a plea of guilty to a charge of violation of IC 1971, 35-23-4-3, Ind. Ann. Stat. § 10-4736 (Burns 1956), 1 commonly referred to as the “1935 Firearms Act”; and, on May 21, 1971, received a ten year determinate sentence.
