On December 2, 1996, Plaintiff, Alexis M. Herman, Secretary of Labor for the United States Department of Labor, filed suit pursuant to the Fair Labor Standards Act of 1938 (“the FLSA” or “the Act”), 29 U.S.C. §§ 201-219 (1994), against Defendants, Héctor I.
