SPARKS, Circuit Judge.

On or about January 20, 1898, the petitioner entered into a contract of agency to represent tho Franklin Life Association of Springfield, TIL, hereinafter, referred to as the company, in which it was provided, among other things, that from and after the dato thereof petitioner should receive from the company one-half of the expense loading contained in tho gross premiums on policies of insurance thereafter issued by the company, and, in addition thereto, one-half of the not savings or profits to the company on all nonparticipating policies.
