Appeal from an order of the County Court of Ulster County (Czajka, J.), entered October 23, 1997, which granted defendant’s motion to dismiss the indictment.
In February 1997, defendant was arrested and charged with two counts of driving while intoxicated as a misdemeanor and two Vehicle and Traffic Law violations.
