LYNCH, Circuit Judge.

Bernice Aponte-Rodríguez and her husband, Victor Lebrón-Ríos, appeal the “with prejudice” aspect of the district court’s dismissal with prejudice of their employment discrimination claims under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. (2000). The district court ordered dismissal because the plaintiffs failed to file charges of discrimination with the Equal Employment Opportunity Commission before bringing suit. We hold that the district court’s dismissal should have been without prejudice to any *9later Title VII action brought by the plaintiffs…
