Appeal from an order of the Surrogate’s Court of Clinton County (Ryan, S.), entered April 25, 2016, which granted petitioners’ application, in a proceeding pursuant to Domestic Relations Law article 7, to determine that respondent’s consent was not required for the adoption of the child.
Respondent (hereinafter the father) is the biological father of a son (born in 2015) who was born while the father was incarcerated in state prison.
