Appeal from an order of the Family Court of Rensselaer County (Griffin, J.), entered July 18, 2005, which granted petitioners’ application, in a proceeding pursuant to Domestic Relations Law article 7, to find that respondent’s consent was not required for the adoption of Gionna L.
Respondent is the biological father of Gionna L. (born in 2004). Shortly after the child’s birth, her mother executed a judicial surrender, agreeing to place the child with New Hope Family Services, Inc. so that the child could be placed with prospective adoptive parents. In June 2004, petitioners…
