— The issue before the court as framed on remand by the Superior Court, is the determination and imposition of costs and counsel fees for a frivolous appeal to the Superior Court. Barbara Reichle, who was represented by the public defender, had entered into a negotiated guilty plea to a count of DUI, in exchange for the Commonwealth’s agreement to nol pros the remaining charges, and recommend the'mandatory mini-, mum sentence of 48-hours incarceration.
