STEPHENS, Associate Justice.

Appellant, a foreign corporation engaged in interstate commerce, was sued by the appellee in the District Court of Erath County for both actual and exemplary damages resulting from the alleged fraud of appellant’s general agent perpetrated in that county August 15, 1901. The trial, which was before the court without a jury, resulted in a judgment in appellee’s favor for one hundred and fifty dollars as actual damages.
