Honey Brook Estates, LLC, (Developer) appeals an order of the Court of Common Pleas of Chester County (trial court) that affirmed the decision of the Board of Supervisors of Honey Brook Township (Township) to disapprove Developer’s preliminary plan for a townhouse development. Developer contends that the Township deliberately delayed action on its preliminary plan to give the Township time to rezone Developer’s land from residential to agricultural.
