OPINION
ROTH, Circuit Judge:
James S. Calender and Diane Calender appeal the District Court’s September 30, 2011, order granting defendant NVR, Inc.’s, Motion to Dismiss and the court’s September 26, 2012, order granting summary judgment in favor of NV R. For the following reasons, we will affirm the District Court’s orders.
I. Background
